Documents for selling a property: All paperwork, signatures, and deadlines

Approximately 35 documents change hands during a property sale – these come from you, us, your bank, the notary, and three to four public authorities. You will personally sign seven of them. Most delays do not occur with the notary but in week one: this is often because the building file (Bauakte) takes six weeks to obtain, and no one requested it in time. This timeline illustrates each document at the point it is required.

Reihenfolge

The Five Phases and What is Required for Each

  1. 1

Preparation (Weeks 0–3): Gathering all documents that take longer to procure

Land register extract (Grundbuchauszug), building file (Bauakte) with building permit and plans, cadastral map (Flurkarte), information on building encumbrances (Baulasten) and contaminated sites (Altlastenauskunft), development certificate (Erschließungsbescheinigung), energy performance certificate (Energieausweis), living area calculation, modernisation receipts, insurance policy; if let, the tenancy agreement. For flats, instead of a building file: declaration of division (Teilungserklärung), partition plan (Aufteilungsplan), three years' worth of meeting minutes, economic plan, service charge statement (Hausgeldabrechnung), and reserve fund status. Concurrently with the bank: outstanding debt and early repayment penalty (Vorfälligkeitsentschädigung). You will sign: the agency agreement with right of withdrawal (Widerrufsbelehrung) and the property questionnaire regarding known defects.

  2. 2

Marketing (Weeks 3–11): Your only task is to approve the release

The property exposé, photos, and asking price will only go online after your approval. The energy performance certificate (Energieausweis) must be available at the latest by the first viewing, with its key data already included in the advertisement. Towards the end of this phase, the buyer will provide a financing confirmation from their bank; without it, no notary's appointment can be scheduled. Optional: a reservation agreement.

  3. 3

Purchase Agreement (Weeks 11–14): The Notary Drafts, You Review

The notary receives the buyer's details, the land register extract, the purchase price, the handover date, and any special arrangements (inventory, tenancy, defects). They will then prepare a draft agreement, which, if the buyer is a consumer, must be received at least 14 days before notarisation (Beurkundung). We will review the draft with you, covering: conditions for payment (Fälligkeitsvoraussetzungen), exclusion of warranty (Gewährleistungsausschluss), handover procedures, and cost distribution.

  4. 4

Notarisation to Payment (Week 14–21): most correspondence comes from the notary

You sign the purchase agreement – in person or by power of attorney. After that, the notary works: applying for the priority notice of conveyance (Auflassungsvormerkung), notifying the tax office (Finanzamt) of the sale, requesting the certificate of cancellation (Löschungsbewilligung) from your bank, obtaining the waiver of pre-emption rights from the district office (Bezirksamt), and, for flats, the administrator's consent. Once everything is in place, they send the notice of due payment. The buyer usually pays within 10–14 days – the real estate transfer tax (Grunderwerbsteuer) to the tax office, the redemption amount to your bank, and the remainder to you.

  5. 5

Handover & Transfer of Ownership (Week 21–26): the protocol is your final signature

After receipt of payment, you hand over keys and the property against a handover protocol with meter readings. You transfer providers, land tax, and property management; we help with this. The notary applies for the transfer of ownership (Eigentumsumschreibung); the land registry office (Grundbuchamt) registers the buyer upon presentation of the certificate of no objection (Unbedenklichkeitsbescheinigung) – this takes four to twelve weeks in Berlin and no longer concerns you.

What You Actually Sign

Seven signatures, in this order: broker agreement (Maklervertrag) with right of revocation information (Widerrufsbelehrung) (text form suffices), property questionnaire regarding defects, approval of exposé and price, optionally a reservation agreement, the notarised purchase agreement (the only one that is legally binding), the handover protocol – and, for multiple owners or in case of absence, a notarised power of attorney. Everything else is signed by others: The notary notarises, the bank approves the cancellation, the district office waives its pre-emption right, the buyer pays.

The Three Documents That Determine the Schedule

Firstly, the building file (Bauakte) from the district office's building archive (Bauaktenarchiv): two to six weeks, depending on the district. Without a building permit and plans, no bank will finance a house. Secondly, your bank's certificate of cancellation (Löschungsbewilligung): two to six weeks after notarisation – some institutions are quick, some need three reminders. Thirdly, the district office's waiver of pre-emption rights: four to eight weeks, or longer in conservation areas (Milieuschutzgebiete) (large parts of Friedrichshain-Kreuzberg, Neukölln, Pankow, Mitte) because the district can seriously examine the right of pre-emption. We apply for the building file on the first day and ask the bank before notarisation how long it will take.

House or Flat: The Difference in Documentation

For a house, everything revolves around the plot of land and building law: cadastral map (Flurkarte), building encumbrances (Baulasten), contaminated sites, development status (Erschließung), building permit, monument protection information if affected. For an owner-occupied flat, everything revolves around the community: declaration of division (Teilungserklärung), site plan (Aufteilungsplan), minutes, collection of resolutions, economic plan, reserves, service charge statement – and, depending on the declaration of division, the administrator's consent for the sale, without which the purchase agreement remains provisionally invalid. For flats, the energy performance certificate (Energieausweis) applies to the entire building and is held by the management.

Obligation or Option?

Few are legally mandatory: energy performance certificate (GEG), disclosure of known defects (otherwise liability despite exclusion), right of revocation information for the broker agreement, the notarisation itself. Everything else is "just" what buyers and their banks require before they release funds. And that's precisely why it's practically mandatory: a missing extract from the building encumbrance register or an unclear living area delays the financing commitment by weeks – or costs a price reduction.

What It Costs – And Who Pays

Your side: land register extract (Grundbuchauszug) 10–20 €, cadastral map 15–60 €, building file 20–100 €, extract from the building encumbrance register 20–50 €, energy performance certificate 80–500 €, cancellation of the land charge (Grundschuld) approximately 0.2% of the registered sum, if applicable, early repayment penalty (Vorfälligkeitsentschädigung). All together, without early repayment penalty, usually under 1,000 €. The buyer's side bears notary fees (around 1.5% of the purchase price including land register), real estate transfer tax (6% in Berlin), and administrator's consent. The broker's commission is split between both parties, with us only upon success.

Unsere Rolle

What We Handle for You From This

Of the approximately 35 documents, you need to provide or sign about eight yourself. We, the notary, or the bank procure the rest.

  • Authorities on Day One

Building file, cadastral map, building encumbrances, contaminated sites, development status – we submit all applications with your power of attorney as soon as the mandate is confirmed.

  • Contacting the Property Management

Declaration of division, minutes, economic plan, energy performance certificate, administrator's consent – we request them and follow up.

  • Completeness Check Before Launch

Only when everything is available does the exposé go online. Submitting documents later costs trust and money.

  • Review the Draft Purchase Agreement with You

We go through every clause before you go to the notary: due date, handover, warranty, inventory.

  • Coordinating the bank and notary

Deed of Release, redemption amount, escrow requirement – we keep the execution moving.

  • Document the Handover

Protocol, meter readings, keys, photos. You receive a complete file of the sale.

Vermeiden

What Delays the Sale by Weeks

  • Only apply for the building file when the buyer asks

Six weeks waiting time, during which the buyer's financing expires. Apply on the first day.

  • Advertise with an expired energy certificate

Ten years validity – many from the first wave of 2008/2009 are long since invalid. Fine and buyer distrust.

  • Concealing Known Defects

The exclusion of warranty does not protect against malice. Damp basement, old electrics: disclose openly, take into account in the price.

  • Leave the Deed of Release to the Notary

The notary requests it, but the bank sometimes needs a reminder. Those who follow up get their money weeks earlier.

  • Living Space from Memory

'Approximately 140 square metres' becomes a figure in the contract for which you are liable. Present calculation according to WoFlV.
