Selling a house during divorce in Berlin: What to do now

In most divorces, the shared home is the largest asset, the biggest debt, and the most emotional place all at once. Sticking to the correct sequence now will save money, months, and disputes. This page is your roadmap: what to do first, what next, what you should not do – and how we, as a neutral estate agent, can support you.

Reihenfolge

The 8 steps in the correct order

  1. 1

    Clarify ownership and debts

Obtain a current extract from the land register (Grundbuch) (from the land registry office (Grundbuchamt) at the local court (Amtsgericht) or online via the land register portal). Who is listed with what share in Section I, and which land charges (Grundschulden) are in Section III? Request the current outstanding debt, fixed interest period, and a non-binding calculation of the early repayment penalty (Vorfälligkeitsentschädigung) from the bank.

  2. 2

    Agree on interim arrangements

Who stays in the house until the sale, who pays the mortgage instalments, land tax (Grundsteuer), insurance, heating? The partner who has moved out can demand compensation for use (Nutzungsentschädigung). Document the arrangement in writing – even informally. This prevents the first major dispute.

  3. 3

    Obtain a neutral market valuation

Before discussing assumption or sale, both parties need the same figure. We appraise the house on-site – valuing the plot according to its standard land value (Bodenrichtwert), and the building according to its condition, energy standard, and comparable sales in the district – and send the derivation to both parties simultaneously.

  4. 4

    Calculate the three options

Joint sale, assumption by one partner, or rental. With the calculator below, you can see in Euros what remains for whom with each option. Only then is it worthwhile discussing preferences.

  5. 5

    Involve the bank

If one partner assumes the property, the bank must release the departing partner from liability – a full credit check of the remaining partner will be required. For a sale, the notary will later require a deed of release (Löschungsbewilligung). Both take weeks; initiate them early.

  6. 6

Coordinate taxes and equalisation of accrued gains (Zugewinn)

Speculation period (ten years, exception for owner-occupation), cut-off date for accrued gains (service of the divorce petition), exemption from real estate transfer tax (Grunderwerbsteuer) for transfers between spouses. A brief discussion with a tax advisor and lawyer – using our valuation as a basis.

  7. 7

    Commission the sale – jointly

An agency agreement with both owners as clients. Marketing discreetly or publicly, viewings without your presence, offers sent to both simultaneously.

  8. 8

    Notary, distribution of proceeds, handover

Both parties sign the purchase agreement (or grant power of attorney). The notary repays the loan and pays the remainder proportionally into two accounts. Handover with a protocol, meter readings, and keys – we also handle this.

Selling, even if the year of separation is still ongoing?

Yes, that is possible – if both agree. The year of separation (Trennungsjahr) is a prerequisite for divorce, not for the sale. Those who sell early already have the proceeds in their account when it comes to accrued gains and maintenance, and no longer bear any value risk. Those who wait must have the house reliably valued at the latest by the deadline for the divorce petition, because this value is included in the equalisation of accrued gains.

Keeping the house – for the children?

The wish is understandable, but the sums often don't add up: The remaining partner needs to cover the outstanding debt, the compensatory payment to the other, and the ancillary costs alone – as a sole earner, often with maintenance obligations. We honestly calculate whether that works. If not, a swift sale with subsequent renting in the same school vicinity is usually a more stable solution for children than years of financial strain.

Special considerations for houses compared to flats

With a house, a large part of the value lies in the plot of land – we consult the standard land value (Bodenrichtwert) from the expert committee (Gutachterausschuss) and check whether subdivision or densification increases the value. The energy performance certificate (Energieausweis) (demand-based certificate (Bedarfsausweis) for houses built before 1977), heating age, roof, and windows determine buyer financing more strongly than for flats. Furthermore: A house is harder to 'halve' – the actual division into two flats is only realistic for two-family houses.

What happens to the loan

Upon sale, it is repaid from the purchase price. If the fixed interest period (Zinsbindung) is still running, the bank calculates an early repayment penalty (Vorfälligkeitsentschädigung) – for outstanding debts of €200,000 to €400,000, this is often a five-figure amount. It is deducted from the proceeds before distribution. If one partner assumes the loan, it continues; the bank assesses the assuming party like a new customer.

Unsere Rolle

What we as a neutral agent take on for both parties

Our client is not one of you, but the property itself. This keeps us out of the conflict and makes us useful to both parties.

  • Valuation with transparent derivation

Standard land value, comparable sales, condition, energy – every figure transparent, sent to both simultaneously, and to both lawyers upon request.

  • Takeover Check

We calculate the compensatory payment and the overall financing for the remaining party and accompany the discussion with the bank regarding release from liability (Haftentlassung).

  • Documents complete

Land register (Grundbuch), building plans, cadastral map, energy performance certificate, living space calculation, insurance policies, modernisation receipts – we request whatever is missing.

  • Communication via us

Appointment suggestions, purchase offers, queries – every piece of information goes to both parties. You do not have to negotiate with each other.

  • Viewings without you present

Keys by post or handover; we conduct all appointments. Personal items are removed from view before photos.

  • Notary and two accounts

We coordinate the purchase agreement with the notary, organise powers of attorney, and arrange the proportionate payout of the proceeds directly to both parties.

Vermeiden

The five most expensive mistakes

  • Playing for time

Every month costs mortgage payments, ancillary costs, and nerves. Whoever obstructs risks the forced sale to dissolve a community (Teilungsversteigerung) – and thus 15–35% less for both.

  • Taking the value from an online portal

Online estimates know neither the condition nor the plot of land. They provide a starting point for dispute, not for agreement.

  • Promising a takeover before the bank agrees

The release from liability is a new assessment. If it fails after months, everything starts from scratch.

  • Moving out and transferring the share years later

May cost the exemption from speculative gains tax (Spekulationssteuer) (BFH IX R 11/21). Speak with a tax advisor beforehand.

  • Two agents, two prices

Each partner brings 'their' agent – and both valuations differ by €80,000. A neutral instruction is quicker.
