Selling a House due to Divorce in Berlin

The decision has been made: the house is to be sold due to the divorce – or at least the sale is being discussed. Now it's about achieving the best possible price, fairly distributing the proceeds, and managing the process so that it doesn't burden either of you more than necessary. And before you sign: an honest answer as to whether selling is really the best of the three options.

Three Options, Honestly Compared

Joint Sale: Highest proceeds, clean break, both are debt-free. Takeover by one partner: Often desired emotionally, financially only viable if the bank and compensatory payment align. Rental: Retains value, but ties you together – joint decisions on tenants, repairs, tax declaration. In our experience, renting between separated parties is the option that most frequently ends in a sale after two years anyway – then with tenants and a lower price.

How the Proceeds are Actually Distributed

From the purchase price, the outstanding debt, any prepayment penalty, and the ancillary selling costs are deducted first. The remainder is distributed according to the land register shares – usually 50/50, regardless of who contributed more. Unequal contributions (equity, inheritance, instalments paid solely by one party) are not settled by the notary but are offset in the equalisation of accrued gains (Zugewinnausgleich). The notary can pay out the proceeds directly into two accounts, so neither party has to transfer money to the other.

Prepayment Penalty: Avoid or Negotiate

If the loan is repaid before the end of the fixed interest period, the bank demands compensation for lost interest – depending on the remaining term and interest rate level, 2 to 10% of the outstanding debt. Three ways to reduce it: The buyer takes over the loan (rare, but attractive with favourable old interest rates), one partner transfers it to another property (collateral exchange (Pfandtausch)), or the ten-year notice period according to § 489 BGB has already been reached. We will check this with the bank for you.

The Right Time to Sell

Economically, the market counts, not the divorce date. Since 2023, Berlin has again seen increasing demand for detached houses with a good energy balance, while unrenovated houses remain on the market longer. For the equalisation of accrued gains (Zugewinnausgleich), the value on the day the divorce petition is served is decisive. Anyone who sells before this date has a fixed figure instead of a dispute over valuations.

Sell Discreetly if Neighbours Shouldn't Know

Many couples do not want their separation to become public via a property portal. Upon request, we market properties without advertising: through registered prospective buyers, financing partners, and our network. The price does not suffer for detached houses in sought-after Berlin locations – the pool of buyers is large enough.

Unsere Rolle

Why a neutral estate agent is more valuable here than usual

In a normal sale, we reduce effort. In a divorce, we also resolve conflict.

  • Both are clients

One contract, two signatures, equal information. Neither has an information advantage.

  • Transparent Offers

Every purchase offer is sent to both parties in writing. Who wishes to accept and who does not is documented – no recriminations later.

  • Bank Discussions

We coordinate the outstanding debt, prepayment penalty, consent to deletion, and – in the event of a takeover – the release from liability.

  • Two-account disbursement

We prepare the proportional disbursement of the proceeds with the notary. No one has to transfer money to the other.

  • Time buffer for children

Handover date after the school year, staggered move-out, coordinated relocation – we negotiate this with the buyer.

  • Only upon successful sale

No upfront costs. The commission is only due upon the notarised purchase agreement and is paid from the proceeds.

Vermeiden

What reduces the proceeds

  • An excessively high starting price out of principle

Anyone who starts high out of defiance creates a 'stale listing' signal. After eight weeks without enquiries, you sell below market value.

  • Showing a partially cleared house

A visibly abandoned children's room or missing furniture pieces tell the story – and buyers will negotiate based on that.

  • Renting out as a compromise

It sounds peaceful but ties separated parties together for years. A later sale with a tenant then means 15–25 % less in price.

  • Accepting an early repayment penalty without asking

Banks calculate differently. A review of the calculation by the Consumer Advice Centre costs little and sometimes saves thousands.
