The Process of Selling an Apartment

First, the value and asking price are determined and the documents are compiled. This is followed by the exposé, photos and marketing, bundled viewings and the vetting of prospective buyers. Once a buyer with secured financing has been found, the notary's office prepares the purchase agreement. After notarisation, the buyer pays as soon as the notary confirms the due date, and the apartment is handed over.

Documents of the Owners' Association

In addition to the land register extract (Grundbuchauszug), floor plan and energy performance certificate, buyers expect the declaration of division (Teilungserklärung), the minutes of the last three owners' meetings, the current budget plan, the service charge statement (Hausgeldabrechnung) and information on the maintenance reserve fund. Decided special assessments or upcoming renovations should be communicated openly – they will appear in the documents anyway.

Costs for Sellers

When selling, the buyer typically bears the costs for the notary, land register and real estate transfer tax (Grunderwerbsteuer). On the seller's side, costs may include the deletion of a land charge (Grundschuld), an early repayment penalty for an ongoing loan, the energy performance certificate and – if commissioned – the estate agent's commission. For rented apartments sold within ten years of purchase, speculation tax (Spekulationssteuer) may also arise.
