Speculation Tax on Property Sales

Anyone selling a property they haven't owned for long may owe speculation tax – sometimes a five-figure sum. Whether it applies depends on two questions: How long have you owned the property, and have you lived in it yourself? We explain the rules so that you know where you stand before the sale. Note: We are real estate agents, not tax advisors – the binding calculation belongs in the hands of your tax advisor.

What speculation tax (Spekulationssteuer) actually is

The "speculation tax" (Spekulationssteuer) is not a separate tax, but rather the taxation of a private disposal transaction under § 23 EStG. If you sell a property at a profit within the applicable period, this profit counts towards your taxable income and is subject to your personal income tax rate. There is no fixed percentage – the higher your other income, the more expensive the profit.

The 10-year period

The relevant period is the span between purchase and sale – each calculated from the date of the notarised purchase agreement, not from handover or entry in the land register (Grundbuch). If more than ten years pass between your purchase and sale, the profit is tax-free, regardless of the amount. Only if you sell within the ten years does it become relevant.

Owner-occupancy exception

If you have occupied the property yourself in the year of sale and the two preceding calendar years, the sale is tax-free – even within the ten years. It is sufficient for owner-occupancy to have existed in the year of sale and the two calendar years before; these periods do not have to comprise a full 24 months but must be contiguous. This rule saves many owner-occupiers from tax.

How profit is calculated

The taxable profit is: selling price minus acquisition costs (purchase price plus ancillary costs at the time, such as real estate transfer tax (Grunderwerbsteuer), notary, agent) minus selling costs. In addition, depreciation (AfA) previously claimed will be added back to the profit, which increases the taxable amount. Your personal income tax rate will be applied to the result.

Rented properties and capital investments

For rented properties, the owner-occupancy exception does not apply. Here, only the 10-year period counts. Anyone selling a capital investment before the deadline expires should definitely have the tax effect calculated in advance – it is often worthwhile to postpone the sale until after the key date.

Special case: inherited property

When inheriting, the period is not restarted: you step into the shoes of the deceased (Erblasser), meaning their original purchase date counts. If the deceased purchased the property more than ten years ago, you can generally sell it tax-free. Owner-occupancy by the deceased can also continue to have effect.

How we support you

We determine the relevant key dates from your purchase agreement data, assess whether you are likely to be subject to tax, and coordinate the optimal selling time with you and your tax advisor. This way, you avoid unpleasant surprises and do not forfeit profit to an avoidable tax.

Common mistakes concerning speculation tax

  • Incorrect key date

Many calculate from handover or land register entry. However, the decisive date is that of the notarised purchase agreement – for both purchase and sale.

  • Owner-occupancy overestimated

The exemption requires owner-occupancy in the year of sale and the two calendar years before. A short period of owner-occupancy only at the end is not sufficient.

  • Forgetting AfA (depreciation)

Previously claimed depreciation is added back to the profit and increases the tax – a frequently overlooked item.

  • Sale shortly before the key date

Anyone selling a few weeks before the ten years expire may pay a five-figure tax amount that could be entirely avoided by waiting a little longer.
